Understanding DVOs in Queensland

Domestic Violence Orders (DVOs) in Queensland are handled under the Domestic and Family Violence Protection Act 2012. They're obtained through the Brisbane Magistrates Court (363 George Street), not the Family Court.

There are several ways a DVO can be initiated:

  • Police Protection Notice: Police can issue immediate protection if they respond to a domestic violence incident
  • Police Application: Police can apply to the court on your behalf
  • Private Application: You can apply directly to the Magistrates Court

How this affects parenting matters: If you have a DVO in place, the Family Court must be informed. The court will consider family violence when making parenting orders — a child's safety is the foremost consideration under Section 60CC of the Family Law Act.

What Brisbane Locals Wish They Knew

The entrance that matters

The court address says '119 North Quay' but the actual entrance is on Tank Street. Taxis and rideshares should drop you on Tank Street, not North Quay—you'll save yourself confusion on an already stressful day.

Security takes time

Expect airport-style security screening. Arrive 20-30 minutes before your hearing time. Phones must be silenced, and recording is strictly prohibited. Leave anything that could be seen as a weapon at home.

The $50 parking mistake

The difference between driving up and pre-booking can exceed $50 per day. For a 3-day trial, that's $150 you could have saved. Book 85 North Quay early bird ($19) or pre-book 40 Tank Street online.

Facilities for parents

The court has parents' rooms with baby changing facilities on the Ground Floor and Level 3. Don't stress if you need to bring young children—the staff understand family law realities.

The Tuesday-Thursday window

File applications Tuesday to Thursday between 10am-2pm. Mondays are chaotic with weekend backlog, and Fridays have deadline pressure. Mid-week, mid-day gives you the calmest experience.

Digital is preferred

Brisbane registry strongly prefers online filing through the Commonwealth Courts Portal. Paper filing still works but may take longer to process. Get comfortable with the portal early.
