Chapter 1

The Reality You're Facing

If you're reading this, you're probably dealing with one of the hardest things a parent can face. The legal system can feel overwhelming, especially in Western Australia where the court structure is genuinely different from the rest of Australia.

You're Not Alone

About 35% of parents in Perth represent themselves in family law matters. You don't necessarily need a lawyer to protect your children's interests.

This guide cuts through the complexity. We've researched the Family Court of WA's unique dual-jurisdiction system, mapped the practical logistics of 150 Terrace Road, and compiled every support service that can help you. Whether you're married or de facto, this is your roadmap.

Chapter 2

WA's Unique Court System

Western Australia is the only state that kept its own Family Court. This matters because it changes which laws apply to you.

If You Were Married

Family Law Act 1975 (Cth)

  • Federal law applies to your matter
  • Same principles as rest of Australia
  • Use federal application forms
  • The 2024 federal reforms fully apply

If You Were De Facto

Family Court Act 1997 (WA)

  • WA state law applies to your matter
  • Similar principles, mirrored from federal law
  • Use WA-specific application forms
  • Must prove relationship existed (2+ years or child)

The Good News

Both streams are heard at the same court (150 Terrace Road), by the same judges, with similar outcomes. The practical difference is mainly administrative—different forms and slightly different thresholds. The court staff can help you identify which stream applies to your situation.

WA has its own protection order system.

Men's DV Helpline: 1800 000 599

How FVROs Interact with Family Court

  • FVROs can restrict a parent's time with children, directly affecting Family Court orders
  • Family Law Act overrides state orders to the extent of inconsistency, but safety is always prioritised
  • You must inform the Family Court of any existing FVROs when filing
  • The 2024 reforms strengthen protection against family violence in parenting decisions
Chapter 8

Insider Tips for Perth

Practical knowledge that makes a difference.

WA has its own Family Court

Unlike every other state, Western Australia refused to refer family law powers to the Commonwealth. The Family Court of WA is a state court that also exercises federal jurisdiction—meaning different forms and sometimes different rules apply here.

De facto couples have different rules

If you weren't married, your matter falls under the Family Court Act 1997 (WA), not the federal Family Law Act. The principles are similar, but the forms and some thresholds differ. Make sure you're using WA-specific forms.

eCourts Portal is mandatory

The Family Court of WA has fully transitioned to digital filing via the eCourts Portal. Paper filing is only for exceptional circumstances. Get familiar with the portal before you need to use it under pressure.

JP services end at 1pm

The on-site Justice of the Peace at 150 Terrace Road only operates from 9:30am to 1pm. If you need documents witnessed in the afternoon, try Citizens Advice Bureau at 25 Barrack Street (open until 3:30pm).

Self-serve kiosks available

If you don't have a scanner or reliable internet, the registry has self-serve kiosks for scanning and uploading documents (9am-4pm). Staff can help with the mechanics but cannot give legal advice.

Call ahead for regional matters

The court covers all of WA—from Broome to Albany. If you're outside Perth, use the Country Free Call (1800 199 228). Many matters can be handled via video link, but check logistics early.
